E-GIFT CARD TERMS AND CONDITIONS
These E-Gift Card Terms and Conditions (hereinafter referred to as the "Gift Card Terms") govern the issuance and use of E-Gift Cards sold via the official Viktor&Rolf online store (www.viktor-rolf.com).
The digital Gift Cards (hereinafter referred to as the "Gift Cards") are directly issued and sold by VIKTOR & ROLF B.V., a private company incorporated under Dutch law, having its registered office at Danzigerkade 55, 1013 AP Amsterdam, the Netherlands, and registered with the Dutch Chamber of Commerce under number 34128921 (hereinafter referred to as the "Seller").
By purchasing or using a Gift Card, the Customer acknowledges to have read and accepted these Gift Card Terms.
1. SCOPE AND DEFINITIONS
1.1 These Gift Card Terms apply to the legal relationship between the Seller and any person who purchases, holds or redeems a Gift Card.
1.2 The Gift Card is a digital, non-personalised voucher issued in EUR (Euros). While the value is administered and maintained in EUR, the official Viktor&Rolf online store (www.viktor-rolf.com), may display prices and transaction values in the customer’s local currency depending on their location. Currency conversion at checkout may result in minor variations due to exchange rate fluctuations.
1.3 Gift Cards do not constitute a financial product, credit card, or electronic money under applicable law. No VAT is charged upon the sale of a Gift Card. VAT shall apply at the time of redemption.
1.4 These Gift Card Terms prevail over other general or platform terms in so far as they relate to the purchase or use of Gift Cards.
2. PURCHASE, DELIVERY AND ACTIVATION
2.1 Gift Cards can be purchased exclusively in EUR and are delivered digitally via email to the address provided during the purchase process.
2.2 A Gift Card is activated upon successful completion of payment. Once activated, the Gift Card is immediately available for use.
2.3 The Seller reserves the right to refuse or cancel orders if there is a suspicion of fraud, error, or misuse.
3. USE OF THE GIFT CARD
3.1 Gift Cards may be used exclusively on the Viktor&Rolf online store. Redemption on other regional or international platforms may be restricted.
3.2 Redemption occurs by entering the Gift Card code during the checkout process. The corresponding amount will be deducted from the available balance.
3.3 Should the purchase amount exceed the Gift Card balance, the remaining amount must be paid using any other accepted payment method.
3.4 Multiple Gift Cards may be used in a single transaction.
3.5 Gift Cards may be used in conjunction with promotional offers or discounts, unless otherwise specified.
3.6 Gift Cards cannot be used to purchase other Gift Cards and are not redeemable for cash.
3.7 Gift Cards are non-reloadable. Once fully redeemed, the Gift Card expires automatically.
3.8 Commercial resale or use of Gift Cards for business purposes is prohibited without prior written consent from the Seller. Transfer of a Gift Card is only permitted without compensation.
4. VALIDITY AND BALANCE
4.1 Each Gift Card is valid for a period of twenty-four (24) months from the activation date, unless otherwise stated.
4.2 Upon expiry, any remaining balance shall be forfeited without the right to reimbursement.
4.3 Customers may consult the remaining balance and expiration date via the link provided in the original email or by contacting Customer Support.
4.4 If contact details are available, the Seller may – without obligation – send a reminder prior to the expiration date.
5. RIGHT OF WITHDRAWAL
5.1 The Customer has the right to withdraw from the purchase of a non-redeemed Gift Card within fourteen (14) days from the activation date.
5.2 Where a Gift Card has been partially or fully redeemed within the withdrawal period, the right of withdrawal shall lapse pursuant to Article 6:230p(d) of the Dutch Civil Code.
5.3 To exercise the right of withdrawal, the Customer may contact: store@viktor-rolf.com.
5.4 Once a Gift Card has been (partially) redeemed, it can no longer be returned, refunded, or exchanged.
6. RETURNS AND REFUNDS FOR PURCHASES
6.1 In the event a product purchased with a Gift Card is returned, the refund amount will be credited back to the original Gift Card.
6.2 If the Gift Card was fully redeemed, the card shall be reactivated with the refunded amount.
6.3 Where a product was purchased using both a Gift Card and an alternative payment method, refunds shall be proportionally applied to both methods.
7. LOSS, THEFT AND LIABILITY
7.1 The Customer is solely responsible for securing the Gift Card code upon receipt. The Seller accepts no liability for loss, theft, misuse, or unauthorised use of a Gift Card.
7.2 The Seller shall not be held liable for delays, delivery failures or technical errors beyond its control, including network interruptions, spam filters or incorrect user data.
7.3 Lost or stolen Gift Cards will not be replaced and any residual value shall not be reimbursed or transferred.
8. FRAUD, BLOCKING AND SUSPENSION
8.1 The Seller reserves the right to suspend, invalidate or block a Gift Card in cases of suspected fraud, technical error, abuse, or violations of these Gift Card Terms.
8.2 In circumstances constituting force majeure, the Seller may temporarily suspend Gift Card usage.
9. CURRENCY AND EXCHANGE RATES
9.1 Gift Cards are issued and maintained in EUR. For the customer’s convenience, product prices and Gift Card balance may be shown in the local currency during checkout. However, the effective value deducted from the Gift Card remains based on the EUR amount and prevailing exchange rates.
9.2 The Seller is not responsible for currency conversion rates or related charges imposed by financial institutions or payment providers.
9.3 Customers are advised that exchange rate fluctuations may cause minor differences between the displayed local currency equivalent and the actual amount deducted in EUR. The Seller is not liable for any such differences.
10. AMENDMENTS TO TERMS
The Seller may modify these Gift Card Terms at any time. The current version is available on www.viktor-rolf.com. Continued use of a Gift Card after such amendments constitutes acceptance thereof.
11. APPLICABLE LAW AND JURISDICTION
11.1 These Gift Card Terms shall be governed exclusively by the laws of the Netherlands.
11.2 Any disputes arising out of or relating to the use or interpretation of the Gift Card Terms shall be submitted to the competent courts of Amsterdam, the Netherlands, unless otherwise prescribed by mandatory law.
11.3 If any provision of these Gift Card Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12. THIRD-PARTY PERSONAL DATA (GIFT CARD RECIPIENTS)
12.1 When purchasing a Gift Card as a gift for another individual, the Customer may be required to provide personal data of the recipient, such as their name and email address.
12.2 By providing such information, the Customer confirms that they have obtained the recipient’s authorisation or have a lawful basis to share their data with the Seller for the sole purpose of delivering the Gift Card.
12.3 The Seller shall process this personal data in accordance with its Privacy Policy , which includes information about the rights of data subjects and how to exercise them.
